New Rules Issued for PFAS in Consumer Products in New Mexico

BAAR, SWITZERLAND / AGILITYPR.NEWS / June 05, 2026 / SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 075.26, reporting on New Mexico’s Environmental Improvement Board’s (EIB) publication of the state’s final rule (permanent rule) for its Per- and Polyfluoroalkyl Substances Protection Act (PFAS Protection Act).


Many chemicals from the PFAS family are harmful to human, animal and environmental health, due to their toxicity and bioaccumulative characteristics, and have been subject to bans or restrictions across the world.


Following the signing into law in New Mexico of the PFAS Protection Act in 2025, the EIB was authorized to adopt rules for the implementation of the Act. On May 5, 2026, the EIB also published a final rule in the state register to support implementation by stakeholders.


The new rule includes key sections on definitions, prohibitions on PFAS-containing products and exemptions. Specifications for currently unavoidable use (CUU), reporting requirements, labeling, testing, reporting fees and schedules are also set out. Stakeholders such as manufacturers, importers, distributors and retailers throughout the New Mexico product chain will be affected by the changes.
