BAAR, SWITZERLAND / AGILITYPR.NEWS / July 30, 2026 / SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 097.26, highlighting multiple California Proposition (Prop 65) settlements reached involving a range of consumer goods containing listed chemicals.

Passed overwhelmingly by California residents in November 1986, the state’s Prop 65 is the Safe Drinking Water and Toxic Enforcement Act of 1986, which requires the state to publish a list of chemicals known to cause cancer, birth defects or reproductive harm. The list has evolved since its first publication to include approximately 900 chemicals.

A Prop 65 settlement is a consent agreement between the parties named in the settlement and any party not named in the settlement is not bound by its terms.

Clear and reasonable warnings must be provided before companies can knowingly and intentionally expose anyone to a chemical listed under Prop 65. Without a permitted exemption, businesses have 12 months to comply once a chemical is listed, and failure may result in lawsuits and civil penalties of up to USD 2,500 per violation per day. A recent update to the requirements for short-form warnings has stipulated that the name of at least one chemical must be included, beginning January 2028.
